The French court of justice which is the most important jurisdiction
in France, finally decided on this controversial topic.
The matter of
clientele ownership concerns franchises, as well as other organizations of
independent businesses.
The French court of justice pronounced on March 2nd
2002 the judgment affirming that the franchisee owns his clientele and thus can
beneficiate of the status applicable to commercial leases.
This decision put
the light on a matter concerning not only the franchisee’s relation with the
locale renter, but also his relation with the franchisor.
This speculates
the franchisee to be an independent head of company.
